User's terms of use and agreements

1. TERMS

1.1. The Terms of Use (from now on referred to as the "Rules") rule the use of the websites: www.cargocv.eu, www.cargocv.com, www.cargocv.lt, www.cargocv.pl (from now on referred to as the System). During registration in the System, the User undertakes to familiarize himself with the current version of the Rules.

1.2. The System Administrator (from now on - the Administrator) means UAB "Eurospektras", a legal entity registered at Laisves pr. 88, LT-06125 Vilnius, Lithuania.

1.3. Employer - a legal entity registered in the System per these Rules.

1.4. User - an individual (applicant) or an employee (manager) of the Employer (if the User is a legal entity).

1.5. Account - data about the User stored in the System, necessary for his identification (authentication), and granting access to the System (login, password).

1.6. Vacancy - An employment position posted on the system until the 31st day of the calendar month.

1.7. Resume - information about skills, work experience, education required for employment, published in the System by the User.

2. REGISTRATION

2.1. During registration, the User agrees with these Rules and thereby confirms that he has read their terms and conditions and agrees with all the provisions of these Rules.

2.2. Users must have and use only one active Account.

2.3. At the time of registration in the System, the User receives a unique ID. Each User has exclusively one ID.

2.4. When registering, the User promises to provide only reliable data about himself and/or the Employer.

2.5. It is forbidden to register in the System under several and/or fictitious or fake names.

2.6. When registering, the User agrees with the Privacy Policy posted at https://cargocv.eu/privacy-policy

3. USER VERIFICATION

3.1. To check the reliability of the Employer, the Administrator reserves the right to request documents from the Employer or the User, for example, constituent documents, employment contracts, lease agreements for their premises, bills for Internet, mobile or fixed communications Services, personal records of managers, etc.

3.2. The Administrator reserves the right to contact by phone to verify the telephone and address data of the Employer and / or Users.

3.3. The Administrator reserves the right to change the data required to create an Account, verify the Employer, and authorize User's in the System.

3.4. When checking documents or other data of the User, the Administrator reserves the right to suspend or block access to the System for the User or the Employer at any time.

4. PROTECTION OF THE DATABASE AND SOFTWARE

4.1. It is prohibited to intentionally disrupt the operation of the System and/or its server infrastructure.

4.2. It is forbidden to copy data from the System, for example, User's data Resumes, vacancies, including the use of scripts and / or any software tools.

4.3. It is forbidden to distribute and / or transfer information published in the System to third parties, other Users, partners, contractors, friends, relatives, etc.

4.4. It is forbidden to publish information of an illegal nature or information that disrupts the operation of the System into the System.

4.5. It is forbidden to distribute, disclose to third parties, use to create other databases, or otherwise use data from the System.

4.6. It is forbidden to transfer your Account data to third parties, other Users, partners, contractors, friends, relatives, etc.

4.7. It is forbidden to use the Account of another User.

5. RIGHTS AND RESPONSIBILITIES OF THE EMPLOYER

5.1. The Employer is responsible for maintaining the details of his Account. If the Employer has suspicion that the data of his Account have become available to third parties, he must immediately inform the Administrator about this to and by e-mail: info@cargocv.eu

5.2. The Employer undertakes to inform the Administrator of any changes in the Employer's status; for example, a bankruptcy procedure has been started against the Employer, or that the Employer is declared bankrupt or liquidated.

5.3. Job Posting Rules:

5.3.1. It is forbidden to publish vacancies that contain information about several positions available. Each open job or Vacancy must be posted separately.

5.3.2. It is forbidden to duplicate vacancies with identical content.

5.3.3. The Vacancy must be placed in a category that thematically corresponds to the Vacancy description.

5.3.4. The Vacancy must comply with legal requirements and framework and contain accurate and reliable information that meets the moral and ethical standards adopted in society.

5.3.5. It is prohibited to post vacancies belonging to other Employers registered in the System or non-existent vacancies.

5.3.6. It is forbidden to indicate the contacts of other Users, Employers or individuals and/or legal entities not registered in the System.

5.3.7. It is forbidden to publish Jobs containing information of an advertising nature, including any companies, goods sold, Services provided, etc.

5.3.8. All fields in the Vacancy must be filled in according to their name and purpose in one language.

5.3.9. It is forbidden to use a large number of exclamation marks, emoticons, special characters or spaces, transliteration, or write only in capital letters.

5.4. The Employer is solely responsible for the content of the Vacancy.

5.5. The Employer undertakes to indicate whether he is a direct employer or a recruiting agency.

5.6. The Employer undertakes to use the personal data of the User (applicant) only to hold a contest related to their vacancies and not transfer them to other Employers or third parties.

6. RIGHTS AND RESPONSIBILITIES OF USERS

6.1. The User is prohibited from transferring information about the Employer and/or User (Employer's employee) received from the System to other Users and/or third parties.

6.2. Resume publication rules:

6.2.1. It is forbidden for the User (applicant) to publish Resumes that contain information about more than one individual.

6.2.2. It is forbidden to indicate the contact details of other Users or individuals and/or legal entities not registered in the System.

6.2.3. The Resume must comply with the requirements of legal acts and contain accurate and reliable information that corresponds to the moral and ethical standards adopted in society.

6.2.4. It is forbidden to publish Resumes containing information of an advertising nature, including any companies, goods sold, Services provided, etc.

6.2.5. All fields in the Resume must be filled in according to their title and purpose in one language.

6.2.6. It is forbidden to use a large number of exclamation marks, emoticons, special characters or spaces, transliteration, or write only in capital letters.

6.2.7. The User's photo must be real (the picture must have the face of the specific User), clear, not distorted, and also meet the following requirements:

  • The photo must only show one person;
  • The face should be clearly visible in the photo;
  • The photo should not contain irrelevant writings, including advertising;
  • The photo must not contain erotica, pornography, violence, or smoking;
  • The photo should not include contact information (phone, e-mail, website address, etc.);
  • The photo should not have traces of significant processing in a graphic editor (collages, frames, etc.);

The Administration will remove photos that do not meet these requirements without prior notice.

7. RIGHTS AND OBLIGATIONS OF THE ADMINISTRATOR

7.1. The Administrator undertakes to ensure the provision of the selected Services to the Employer following the conditions specified in the description of such Services after receiving payment from the Employer.

7.2. The Administrator reserves the right to change the procedures and menu structure of the System without warning the User.

7.3. The Administrator reserves the right to change the cost, type of Services, and their duration without prior notice.

7.4. The Administrator reserves the right to change the appearance of Vacancies and/or Resumes without prior notice.

7.5. The Administrator reserves the right to suspend and/or interrupt the provision of Services without prior notice, block access to the System or specific sections in general or from specific devices, block the IP address (s), hide or delete a Vacancy and/or Resume, if:

7.5.1. The Employer or User does not fulfill their financial responsibilities to the Administrator.

7.5.2. The Employer or User is in any way connected with other Employers, Users, or persons that have the same legal or actual address, have the same managers or beneficiaries or have the real names of employees hidden, etc. Those who were denied access to the System in connection with insolvency, bankruptcy, improper performance of their financial obligations, violation of the Rules, etc, are also in breach of this clause.

7.5.3. The Employer or the User that violates clauses 2.2, 2.4, 2.5, 4.1 - 4.7, 5.1-5.6, 6.1, 6.2. of these Rules.

8. RESPONSIBILITIES OF THE ADMINISTRATOR

8.1. The Administrator takes all possible measures to ensure the availability of the System and is not responsible for:

8.1.1. Malfunctions or loss of User data caused by reasons beyond the control of the Administrator;

8.1.2. For lack of access or incomplete access to the System due to incorrect operation or breakdown on the side of a contractor providing web hosting Services and / or hosting servers in a data center;

8.1.3. Unavailability of the System caused by incorrect operation of the software or technical means of the User;

8.1.4. System malfunctions as a result of force majeure, factors beyond the control of the Administrator, including unauthorized interference with the System by Users or third parties, for example, DDoS attacks, SQL injections, Cross-Site Scripting, Cross-Site Request Forgery, Man-In-The-Middle, Clickjacking, Brute Force, etc.

8.1.5. For information posted by Users in the System and the consequences of its use is the responsibility of the User.

8.2. The Administrator reserves the right to restrict access to the System for all Users for technical work for a short time (no more than 24 hours).

8.3. The System, represented by the Administrator, is not a party to the contractual relationship that arose between the Users when using the information provided in the System. The personally registered or unregistered User is responsible for all activity.

8.4. The Administrator is not responsible for:

8.4.1. for the content and accuracy of information posted in the System by a User;

8.4.2. for the possible use of the information published by the User or by third parties and the consequences of such use;

8.4.3. for damage or loss that may arise when using the System or in connection with the inability to use the System or its separate functions.

9. PROCEDURE FOR PROVIDING Services

9.1. Information on the cost and period of validity of the Services "Publishing vacancies" and "Access to the Resume database" is posted at:

9.2. In the event of suspension and/or termination of the provision of Services at the request of the Employer, the funds paid by him for the Services of the System before the suspension of Services, including funds for Services that have not expired by the time of suspension, are not subject to a refund to the User or third parties (creditors of the User, etc.).

9.3. In the cases provided for in clause 7.5., Clauses 7.5.1 - 7.5.3, 8.1.1, 8.1.2, 8.1.3, 8.1.4 of the Rules, the funds paid by the User for the Services of the System, which have not expired, are not subject to return.

9.4.Payment for the Services provided can be accepted by the following legal entities: UAB Eurospektras (registration code 126206243, Lithuania), Cargo.PL Sp.z o.o. (registration code 0000519118, Poland), LLC Fironet (registration code 397853526558, Ukraine).

10. FINAL PROVISIONS

10.1. The Administrator reserves the right to change or supplement the Rules at any time unilaterally. The date of the last changes is shown on the web page of the Terms of Service/Rules. The new edition of the rules comes into force from the moment of publication.

10.2. In the event of a change in the Rules, the Administrator notifies the Users in advance by sending an email to the email address specified in the User's Account. Such notifications are deemed to have been appropriately provided to the User.

10.3. Continued use of the System by the User after making changes and/or additions to the Rules means acceptance and consent of the User to the terms with before-mentioned changes and/or additions.

10.4. If the User does not agree with the changes and / or additions to the Rules, he is obliged to notify the Administrator about this within 30 days from the date of publication of the latest changes and / or additions to the Rules by sending an email to info@cargocv.eu from the email address, specified in the User's Account.

10.5. The User is obliged to fully familiarize himself with the Rules before registering in the System. Registration of the User in the System means full and unconditional acceptance of these Rules by the User.

10.6. The Rules constitute an agreement between the User and the Administrator of the System regarding the procedure for using the System and its functionality and replace all previous agreements between the User and the Administrator.

10.7. The rules come into force for the User from the moment of his registration in the System and are valid for an indefinite period.

10.8. Unawareness of the Rules does not absolve from responsibility.
